A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of an investigator employed by a |
|
prosecuting attorney. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 41.109(a), Government Code, is amended |
|
to read as follows: |
|
(a) An investigator appointed by a prosecuting attorney has |
|
the same authority as the sheriff of the county to make arrests |
|
anywhere in the county and to serve anywhere in the state warrants, |
|
capiases, subpoenas in criminal cases, and all other processes in |
|
civil or criminal cases issued by a district court, county court, or |
|
justice court of this state. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
