A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the removal of a political advertising sign after an |
|
election; providing a civil penalty. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 255, Election Code, is amended by adding |
|
Section 255.010 to read as follows: |
|
Sec. 255.010. REMOVAL OF SIGNS RELATING TO ELECTION. (a) A |
|
political advertising sign relating to an election must be removed |
|
not later than the 30th day after the date of the election. |
|
(b) A person who violates this section is liable to this |
|
state for a civil penalty of $100 for each day that a violation |
|
occurs. The attorney general may sue to collect a civil penalty |
|
under this section. |
|
(c) This section does not affect the authority of this |
|
state, an agency of this state, a political subdivision, or a |
|
property owner's association to require the removal of a sign. To |
|
the extent of a conflict between this section and another statute or |
|
a rule, the statute or rule that imposes a stricter regulation or a |
|
greater penalty controls. |
|
SECTION 2. This Act takes effect September 1, 2007. |
