A BILL TO BE ENTITLED
AN ACT
relating to the removal of a political advertising sign after an
election; providing a civil penalty.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Chapter 255, Election Code, is amended by adding
Section 255.010 to read as follows:
       Sec. 255.010.  REMOVAL OF SIGNS RELATING TO ELECTION. (a) A
political advertising sign relating to an election must be removed
not later than the 30th day after the date of the election.
       (b)  A person who violates this section is liable to this
state for a civil penalty of $100 for each day that a violation
occurs. The attorney general may sue to collect a civil penalty
under this section.
       (c)  This section does not affect the authority of this
state, an agency of this state, a political subdivision, or a
property owner's association to require the removal of a sign. To
the extent of a conflict between this section and another statute or
a rule, the statute or rule that imposes a stricter regulation or a
greater penalty controls.
       SECTION 2.  This Act takes effect September 1, 2007.
