A BILL TO BE ENTITLED
AN ACT
relating to the authority of certain municipalities to regulate the
hours of certain businesses that sell alcoholic beverages.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Chapter 105, Alcoholic Beverage Code, is amended
by adding Section 105.10 to read as follows:
       Sec. 105.10.  OPERATING HOURS IN CERTAIN MUNICIPALITIES.  
(a)  An establishment licensed or permitted under this code for the
on-premises consumption of alcoholic beverages whose premises are
located in a municipality with a population of 1.9 million or more,
other than an establishment holding a food and beverage certificate
whose primary business being operated on the premises is food
service, may operate only during the hours during which alcoholic
beverages may be consumed on the premises under this chapter.
       (b)  This section does not affect the hours during which
alcoholic beverages may be sold or consumed on a licensed or
permitted premises.
       SECTION 2.  This Act takes effect September 1, 2007.
