A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of certain municipalities to regulate the |
|
|
hours of certain businesses that sell alcoholic beverages. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 105, Alcoholic Beverage Code, is amended |
|
|
by adding Section 105.10 to read as follows: |
|
|
Sec. 105.10. OPERATING HOURS IN CERTAIN MUNICIPALITIES. |
|
|
(a) An establishment licensed or permitted under this code for the |
|
|
on-premises consumption of alcoholic beverages whose premises are |
|
|
located in a municipality with a population of 1.9 million or more, |
|
|
other than an establishment holding a food and beverage certificate |
|
|
whose primary business being operated on the premises is food |
|
|
service, may operate only during the hours during which alcoholic |
|
|
beverages may be consumed on the premises under this chapter. |
|
|
(b) This section does not affect the hours during which |
|
|
alcoholic beverages may be sold or consumed on a licensed or |
|
|
permitted premises. |
|
|
SECTION 2. This Act takes effect September 1, 2007. |
