A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to judicial review regarding issues other than |
|
|
compensability or income or death benefits under the Texas Workers' |
|
|
Compensation Act. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 410.255(a), Labor Code, is amended to |
|
|
read as follows: |
|
|
(a) For all issues other than those covered under Section |
|
|
410.301(a), judicial review shall be conducted in the manner |
|
|
provided for judicial review of a contested case under Subchapter |
|
|
G, Chapter 2001, Government Code, except that the review must be |
|
|
conducted in the county in which the employee resided on the date of |
|
|
the compensable injury or death that is the subject of the claim. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a proceeding for judicial review initiated on or after the |
|
|
effective date of this Act. A proceeding for judicial review |
|
|
initiated before the effective date of this Act is governed by the |
|
|
law in effect immediately before the effective date of this Act, and |
|
|
the former law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
