A BILL TO BE ENTITLED
AN ACT
relating to judicial review regarding issues other than
compensability or income or death benefits under the Texas Workers'
Compensation Act.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Section 410.255(a), Labor Code, is amended to
read as follows:
       (a)  For all issues other than those covered under Section
410.301(a), judicial review shall be conducted in the manner
provided for judicial review of a contested case under Subchapter
G, Chapter 2001, Government Code, except that the review must be
conducted in the county in which the employee resided on the date of
the compensable injury or death that is the subject of the claim.
SECTION 2.  The change in law made by this Act applies only
to a proceeding for judicial review initiated on or after the
effective date of this Act. A proceeding for judicial review
initiated before the effective date of this Act is governed by the
law in effect immediately before the effective date of this Act, and
the former law is continued in effect for that purpose.
SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
