A BILL TO BE ENTITLED
AN ACT
relating to the use of an employer assessment to fund certain
employment and training investment programs in this state.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subsection (a), Section 204.006, Labor Code, is
amended to read as follows:
       (a)  A person's contribution rate for the calendar year in
which the person becomes an employer is the greater of:
             (1)  the rate established for that year for the major
group to which the employer is assigned under Section 204.004,
[less than one tenth of one percent]; or
             (2)  two and seven-tenths [six tenths] percent.
       SECTION 2.  Subchapter D, Chapter 204, Labor Code, is
amended by repealing Section 204.0625, Adjustment to
Relinquishment Tax Rate.
       SECTION 3.  Chapter 204, Labor Code, is amended by repealing
Subchapter G, Employment and Training Investment Assessment;
Funds.
       SECTION 4.  Chapter 302, Labor Code, is amended by repealing
Subchapter F, Employment and Training Assessment.
       SECTION 5.  Subsection 303.003(a), Labor Code, is amended to
read as follows:
       (a)  To achieve the purposes of this chapter, the skills
development fund is created.  The fund is composed of:
             [(1)  money transferred into the fund under Section
204.123; and]
             [(2)  any amounts appropriated by the legislature for
the purpose of this chapter from the general revenue fund.
       SECTION 6.  Upon the effective date, any money remaining in
the Employment and Training Investment Holding Fund under Section
204.122, Labor Code will be deposited into the Unemployment
Compensation Fund authorized under Subchapter B, Chapter 203, Labor
Code.
       Upon the effective date, any money remaining in the Training
Stabilization Fund under Section 302.101, Labor Code will be
deposited into the Unemployment Compensation Fund authorized under
Subchapter B, Chapter 203, Labor Code.
       Money collected under Subchapter G, Chapter 204, Labor Code,
subsequent to the effective date will be deposited into the
Unemployment Compensation Fund authorized under Subchapter B,
Chapter 203, Labor Code.
       SECTION 7.  This Act takes effect September 1, 2007.
