A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the ownership or operation of a health spa by a |
|
|
municipality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 702, Occupations Code, is |
|
|
amended by adding Section 702.004 to read as follows: |
|
|
Sec. 702.004. OPERATION OF HEALTH SPA BY MUNICIPALITY. A |
|
|
municipality may not own or operate a facility that, if privately |
|
|
owned or operated, would be a health spa. This section does not |
|
|
prohibit a municipality from operating a facility that, if |
|
|
privately owned or operated, would be a health spa if the facility |
|
|
is used only by employees of the municipality and the employees' |
|
|
immediate families. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
