A BILL TO BE ENTITLED
AN ACT
relating to the penalty for the offense of compelling prostitution.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 43.05, Penal Code, is amended to read as
follows:
       Sec. 43.05.  COMPELLING PROSTITUTION.  (a) A person commits
an offense if the person [he] knowingly:
             (1)  causes another by force, threat, or fraud to
commit prostitution; or
             (2)  causes by any means a person younger than 18 [17]
years to commit prostitution, regardless of whether the actor knew
the age of the person at the time the offense was committed.
       (b)  An offense under Subsection (a)(1) [this section] is a
felony of the second degree. An offense under Subsection (a)(2) is a
felony of the first degree.
       SECTION 2.  The change in law made by this Act applies only
to an offense committed on or after the effective date of this Act.
An offense committed before the effective date of this Act is
governed by the law in effect when the offense was committed, and
the former law is continued in effect for that purpose. For the
purposes of this section, an offense is committed before the
effective date of this Act if any element of the offense is
committed before that date.
       SECTION 3.  This Act takes effect September 1, 2007.
