A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the penalty for the offense of compelling prostitution. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 43.05, Penal Code, is amended to read as |
|
follows: |
|
Sec. 43.05. COMPELLING PROSTITUTION. (a) A person commits |
|
an offense if the person [he] knowingly: |
|
(1) causes another by force, threat, or fraud to |
|
commit prostitution; or |
|
(2) causes by any means a person younger than 18 [17] |
|
years to commit prostitution, regardless of whether the actor knew |
|
the age of the person at the time the offense was committed. |
|
(b) An offense under Subsection (a)(1) [this section] is a |
|
felony of the second degree. An offense under Subsection (a)(2) is a |
|
felony of the first degree. |
|
SECTION 2. The change in law made by this Act applies only |
|
to an offense committed on or after the effective date of this Act. |
|
An offense committed before the effective date of this Act is |
|
governed by the law in effect when the offense was committed, and |
|
the former law is continued in effect for that purpose. For the |
|
purposes of this section, an offense is committed before the |
|
effective date of this Act if any element of the offense is |
|
committed before that date. |
|
SECTION 3. This Act takes effect September 1, 2007. |
