A BILL TO BE ENTITLED
AN ACT
relating to retirement benefits for retired Texas Rangers.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 814.107, Government Code, is amended by
amending Subsections (b) and (f) and adding Subsections (b-1),
(b-2), and (b-3) to read as follows:
       (b)  The standard service retirement annuity payable for at
least 20 years of service credit as a law enforcement or custodial
officer is an amount computed on the basis of the member's average
monthly compensation for the 36 highest months of compensation in
the employee class or the amount specified by Subsections (b-1)
through (b-3), if applicable, times the sum of the percentage
factor used in the computation of a standard service retirement
annuity under Section 814.105 plus .5 percent.
       (b-1)  Subject to Subsection (b-2), a law enforcement or
custodial officer may elect to have the person's standard service
retirement annuity computed under Subsection (b) based on the
monthly compensation that is in effect for:
             (1)  the position or employee classification that was
held by the person at the time the person retired; or
             (2)  the position or employee classification in effect
that is most similar to that described by Subdivision (1).
       (b-2)  A person is eligible for a standard service retirement
annuity computed as provided by Subsection (b-1) if the person:
             (1)  was employed by the Department of Public Safety
and commissioned as a Texas Ranger;
             (2)  honorably retires after at least eight years of
creditable service as a Texas Ranger or as a director of the
Department of Public Safety;
             (3)  has at least two years of creditable service in the
commissioned position or employee classification described by
Subsection (b-1)(1); and
             (4)  makes a request to the retirement system for
computation of the person's average monthly compensation under
Subsection (b-1).
       (b-3)  If the monthly compensation for a position or employee
classification described by Subsection (b-1)(1) or (2) is stated as
a range, the amount used to compute the standard service retirement
annuity under Subsection (b-1) is the average monthly compensation
paid to all persons holding the position or employee
classification.
       (f)  The standard combined service retirement annuity
payable for at least 20 years of service credit as a law enforcement
or custodial officer may not exceed 100 percent of the average
compensation computed under Subsection (b) or Subsections (b-1)
through (b-3), as applicable.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
