A BILL TO BE ENTITLED
AN ACT
relating to the dates on which certain political subdivisions hold
elections.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 11.0581, Education Code, is amended to
read as follows:
       Sec. 11.0581.  JOINT ELECTIONS AUTHORIZED [REQUIRED]. (a)
An election for trustees of an independent school district that is
held on the same date as the election of a political subdivision any
portion of which is located in the territory of the school district
may [shall be held on the same date as:
             [(1)  the election for the members of the governing
body of a municipality located in the school district; or
             [(2)  the general election for state and county
officers.
       [(b)  Elections held on the same date as provided by
Subsection (a) shall] be held as a joint election under Chapter 271,
Election Code.
       (b) [(c)]  The voters of a joint election under this section
shall be served by common polling places consistent with Section
271.003(b), Election Code.
       [(d)  The board of trustees of an independent school district
changing an election date to comply with this section shall adjust
the terms of office of its members to conform to the new election
date.]
       SECTION 2.  Section 41.0052(a), Election Code, is amended to
read as follows:
       (a)  The governing body of a political subdivision other than
a county may, not later than December 31, 2007 [2005], change the
date on which it holds its general election for officers to another
authorized uniform election date.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
