A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to the statutory probate court of Collin County. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 25.0453, Government Code, is amended by |
|
adding Subsection (g) to read as follows: |
|
(g) Notwithstanding any other law, on the request of a judge |
|
of a statutory probate court, a judge of a statutory county court in |
|
Collin County may serve for the requesting judge and hear cases, |
|
other than contested matters, pending in that judge's court when |
|
that judge is absent, disabled, or disqualified. The authority |
|
provided by this section applies regardless of whether the court |
|
the statutory county court judge ordinarily serves has jurisdiction |
|
of the types of cases pending in the statutory probate court for |
|
which the judge is requested to serve. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
