A BILL TO BE ENTITLED
AN ACT
relating to local school district policies regarding student
eligibility to participate in extracurricular activities.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter D, Chapter 33, Education Code, is
amended by adding Section 33.0814 to read as follows:
       Sec. 33.0814.  SCHOOL DISTRICT POLICY ON STUDENT ELIGIBILITY
TO PARTICIPATE IN EXTRACURRICULAR ACTIVITIES. (a) Notwithstanding
Section 33.081, the board of trustees of a school district may adopt
a policy governing the eligibility of a student to participate in an
extracurricular activity sponsored or sanctioned by the school
district or the University Interscholastic League after a grade
evaluation period in which the student received a grade lower than
the equivalent of 70 on a scale of 100 in any academic class other
than an identified honors or advanced class.
       (b)  In adopting a policy under this section, the board of
trustees shall consult district faculty, coaches, band directors,
and other appropriate personnel.
       (c)  A policy adopted under this section:
             (1)  may provide for any student disciplinary measure
considered appropriate by the board, including special tutoring
requirements, supervised study hall requirements, library time
requirements, additional practice-time requirements, detention
periods, or periods of suspension from participation in
extracurricular activities;
             (2)  must be consistent with Section 33.081(e), if the
policy provides for suspension from participation in
extracurricular activities of a student with a disability that
significantly interferes with the student's ability to meet regular
academic standards; and
             (3)  prevails over any conflicting provision in Section
33.081, other than Section 33.081(e).
       SECTION 2.  This Act applies beginning with the 2007-2008
school year.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
