A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to local school district policies regarding student |
|
eligibility to participate in extracurricular activities. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter D, Chapter 33, Education Code, is |
|
amended by adding Section 33.0814 to read as follows: |
|
Sec. 33.0814. SCHOOL DISTRICT POLICY ON STUDENT ELIGIBILITY |
|
TO PARTICIPATE IN EXTRACURRICULAR ACTIVITIES. (a) Notwithstanding |
|
Section 33.081, the board of trustees of a school district may adopt |
|
a policy governing the eligibility of a student to participate in an |
|
extracurricular activity sponsored or sanctioned by the school |
|
district or the University Interscholastic League after a grade |
|
evaluation period in which the student received a grade lower than |
|
the equivalent of 70 on a scale of 100 in any academic class other |
|
than an identified honors or advanced class. |
|
(b) In adopting a policy under this section, the board of |
|
trustees shall consult district faculty, coaches, band directors, |
|
and other appropriate personnel. |
|
(c) A policy adopted under this section: |
|
(1) may provide for any student disciplinary measure |
|
considered appropriate by the board, including special tutoring |
|
requirements, supervised study hall requirements, library time |
|
requirements, additional practice-time requirements, detention |
|
periods, or periods of suspension from participation in |
|
extracurricular activities; |
|
(2) must be consistent with Section 33.081(e), if the |
|
policy provides for suspension from participation in |
|
extracurricular activities of a student with a disability that |
|
significantly interferes with the student's ability to meet regular |
|
academic standards; and |
|
(3) prevails over any conflicting provision in Section |
|
33.081, other than Section 33.081(e). |
|
SECTION 2. This Act applies beginning with the 2007-2008 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
