A BILL TO BE ENTITLED
AN ACT
relating to the disclosure by the Texas Department of Public Safety
to appraisal districts of name, date of birth, and address
information for use in determining a person's eligibility for a
residence homestead exemption for the elderly.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 521.049, Transportation Code, is amended
by adding Subsection (d) to read as follows:
       (d)  At the end of each calendar year, the department shall
provide, without charge, information relating to the name, date of
birth, and most recent address as shown in department records of
each person who attained or will attain the age of 65 in that year to
the chief appraiser of the appraisal district that appraises
property for the county in which the person's address is located.
       SECTION 2.  Section 11.43, Tax Code, is amended by amending
Subsection (m) and adding Subsection (m-1) to read as follows:
       (m)  Notwithstanding Subsections (a) and (k), a person who
receives an exemption under Section 11.13, other than an exemption
under Section 11.13(c) or (d) for an individual 65 years of age or
older, in a tax year is entitled to receive an exemption under
Section 11.13(c) or (d) for an individual 65 years of age or older
in the next tax year on the same property without applying for the
exemption if the person becomes 65 years of age in that next year as
shown by:
             (1)  information in the records of the appraisal
district that was provided to the appraisal district by the
individual in an application for an exemption under Section 11.13
on the property or in correspondence relating to the property; or
             (2)  the information provided by the Texas Department
of Public Safety to the appraisal district under Section 521.049,
Transportation Code.
       (m-1)  Subsection (m) [This subsection] does not apply if the
chief appraiser determines that the individual is no longer
entitled to any exemption under Section 11.13 on the property.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
