A BILL TO BE ENTITLED
AN ACT
relating to requiring certain barbers and cosmetologists to have a
product available to reverse certain hair damage.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter C, Chapter 1603, Occupations Code, is
amended by adding Section 1603.106 to read as follows:
       Sec. 1603.106.  DAMAGE TO HAIR.  (a)  A person regulated
under this chapter, Chapter 1601, or Chapter 1602 who provides
chemical hair processing services must have available in the
person's place of business or at a site where chemical hair
processing services are provided a product that:
             (1)  combines water, Luvimer, Si-Tec DMC, and Cellosize
PCG-10; and
             (2)  is used to reverse damage to hair caused by
chemical processing.
       (b)  The commission shall adopt rules necessary to implement
the requirements of this section.
       SECTION 2.  Not later than December 1, 2007, the Texas
Commission of Licensing and Regulation shall adopt rules as
required by Section 1603.106, Occupations Code, as added by this
Act.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
