A BILL TO BE ENTITLED
AN ACT
relating to mobile food units in certain populous counties;
providing a penalty.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Chapter 437, Health and Safety Code, is amended
by adding Section 437.0074 to read as follows:
       Sec. 437.0074.  MOBILE FOOD UNITS IN CERTAIN POPULOUS
COUNTIES.  (a)  A county with a population of at least 2.8 million,
or a municipality or public health district in the county, shall
require a mobile food unit to:
             (1)  return to the food service establishment or
commissary from which the unit operates within each 24-hour period
that the mobile food unit is in operation to have cleaning and other
services performed on the unit; and
             (2)  obtain, on completion of an inspection following
servicing, written documentation that the mobile food unit has been
serviced daily as required by Subdivision (1).
       (b)  A county, municipality, or public health district that
has installed an electronic tagging system, shall:
             (1)  register and record confirmation that the unit has
been serviced as required by Subsection (a)(1); and
             (2)  issue a written copy of the confirmation to the
mobile food unit for the purpose of documentation under Subsection
(a)(2).
       SECTION 2.  Section 37.01(2), Penal Code, is amended to read
as follows:
             (2)  "Governmental record" means:
                   (A)  anything belonging to, received by, or kept
by government for information, including a court record;
                   (B)  anything required by law to be kept by others
for information of government;
                   (C)  a license, certificate, permit, seal, title,
letter of patent, or similar document issued by government, by
another state, or by the United States;
                   (D)  a standard proof of motor vehicle liability
insurance form described by Section 601.081, Transportation Code, a
certificate of an insurance company described by Section 601.083 of
that code, a document purporting to be such a form or certificate
that is not issued by an insurer authorized to write motor vehicle
liability insurance in this state, an electronic submission in a
form described by Section 502.153(i), Transportation Code, or an
evidence of financial responsibility described by Section 601.053
of that code; [or]
                   (E)  an official ballot or other election record;
or
                   (F)  the written documentation a mobile food unit
is required to obtain under Section 437.0074, Health and Safety
Code.
       SECTION 3.  This Act takes effect September 1, 2007.
