A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the timeframe under which an employee must return to |
|
|
work after an emergency evacuation period expires. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 22.002, Labor Code, is amended to read as |
|
|
follows: |
|
|
Sec. 22.002. DISCRIMINATION PROHIBITED. An employer may |
|
|
not discharge or in any other manner discriminate against an |
|
|
employee who leaves the employee's place of employment to |
|
|
participate in a general public evacuation ordered under an |
|
|
emergency evacuation order as long as the employee returns to work |
|
|
within five days after the emergency evacuation period expires. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
