A BILL TO BE ENTITLED
AN ACT
relating to the timeframe under which an employee must return to
work after an emergency evacuation period expires.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 22.002, Labor Code, is amended to read as
follows:
       Sec. 22.002.  DISCRIMINATION PROHIBITED.  An employer may
not discharge or in any other manner discriminate against an
employee who leaves the employee's place of employment to
participate in a general public evacuation ordered under an
emergency evacuation order as long as the employee returns to work
within five days after the emergency evacuation period expires.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
