A BILL TO BE ENTITLED
AN ACT
relating to state aid for certain juvenile justice alternative
education programs that enter into certain revenue sharing
agreements.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  (a) This section applies only to a juvenile
justice alternative education program that:
             (1)  is located in a county that has a population of
less than 1.4 million and contains at least 12 school districts; and
             (2)  for the 2005-2006 school year, received funding as
a result of an agreement between school districts under Subchapter
E, Chapter 41, Education Code.
       (b)  To be entitled to state aid under this section, a
juvenile justice alternative education program that received funds
under an agreement under Subchapter E, Chapter 41, Education Code,
for the 2005-2006 school year must attempt to enter into similar
agreements for the 2007-2008 and 2008-2009 school years with each
school district that participated in an agreement for the 2005-2006
school year with the program.
       (c)  A juvenile justice alternative education program is
entitled to state aid under this section in an amount equal to:
             (1)  for the 2007-2008 school year, the difference
between:
                   (A)  the funding the program received as a result
of all agreements between school districts under Subchapter E,
Chapter 41, Education Code, for the 2005-2006 school year; and
                   (B)  the funding the program receives as a result
of all agreements between school districts under Subchapter E,
Chapter 41, Education Code, for the 2007-2008 school year; and
             (2)  for the 2008-2009 school year, the difference
between:
                   (A)  the funding the program received as a result
of all agreements between school districts under Subchapter E,
Chapter 41, Education Code, for the 2005-2006 school year; and
                   (B)  the funding the program receives as a result
of all agreements between school districts under Subchapter E,
Chapter 41, Education Code, for the 2008-2009 school year.
       (d)  The commissioner of education shall:
             (1)  determine the amount of state aid to which a
juvenile justice alternative education program is entitled under
this section; and
             (2)  distribute the aid in 10 equal monthly
installments:
                   (A)  for the 2007-2008 school year, beginning with
September 2007 and ending with June 2008; and
                   (B)  for the 2008-2009 school year, beginning with
September 2008 and ending with June 2009.
       (e)  The commissioner of education shall adopt rules to
implement this section.
       (f)  A determination of the commissioner of education under
this section is final and may not be appealed.
       SECTION 2.  This Act takes effect September 1, 2007.
