A BILL TO BE ENTITLED
AN ACT
relating to consumer rebates and requiring a person or company that
offers a consumer rebate to provide the rebate to the consumer at
the time of purchase.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Title 2, Competition and Trade Practices,
Chapter 17 is amended by adding Section 18:
       Section 18. Consumer Rebate Protection
       (1)  Upon receipt of a request for redemption which meets the
terms and conditions of a rebate offer, any person or company that
offers a consumer rebate in this state must provide the rebate to
the consumer at the time of purchase.
       (2)  As used in this section, the term "consumer rebate" 
means an offer to provide cash, credit, or credit towards future
purchases which is offered to a consumer who acquires or purchases a
specified product or service and which is conditioned upon the
consumer submitting a request for redemption after satisfying the
terms and conditions of the offer.
       SECTION 2.  This Act takes effect September 1, 2007.
