A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to consumer rebates and requiring a person or company that |
|
|
offers a consumer rebate to provide the rebate to the consumer at |
|
|
the time of purchase. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Title 2, Competition and Trade Practices, |
|
|
Chapter 17 is amended by adding Section 18: |
|
|
Section 18. Consumer Rebate Protection |
|
|
(1) Upon receipt of a request for redemption which meets the |
|
|
terms and conditions of a rebate offer, any person or company that |
|
|
offers a consumer rebate in this state must provide the rebate to |
|
|
the consumer at the time of purchase. |
|
|
(2) As used in this section, the term "consumer rebate" |
|
|
means an offer to provide cash, credit, or credit towards future |
|
|
purchases which is offered to a consumer who acquires or purchases a |
|
|
specified product or service and which is conditioned upon the |
|
|
consumer submitting a request for redemption after satisfying the |
|
|
terms and conditions of the offer. |
|
|
SECTION 2. This Act takes effect September 1, 2007. |
