A BILL TO BE ENTITLED
AN ACT
relating to supplemental instruction provided by public school
teachers.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter I, Chapter 21, Education Code, is
amended by adding Section 21.4023 to read as follows:
       Sec. 21.4023.  ADDITIONAL COMPENSATION FOR SUPPLEMENTAL
INSTRUCTION. (a) A district shall provide additional compensation
to a classroom teacher who voluntarily, but at the direction of the
district, provides supplemental instruction to students before or
after the regular school day.
       (b)  The additional compensation required by this section
must provide an hourly rate of compensation at least equal to the
hourly rate received by the classroom teacher through the teacher's
regular salary.
       (c)  Any compensation provided under this section is not
included in determining whether the district is paying the teacher
the minimum monthly salary under Section 21.402.
       (d)  A school district may use funds provided for an
intensive program of instruction under Section 28.0213(c) to pay
additional compensation required by this section.
       (e)  Notwithstanding any other provision of law, a school
district may not require a classroom teacher to provide
supplemental instruction to a student before or after the regular
school day.
       (f)  For purposes of this section, "regular school day" means
an eight-hour period each weekday.
       SECTION 2.  This Act applies beginning with the 2007-2008
school year.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
