A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to supplemental instruction provided by public school |
|
teachers. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter I, Chapter 21, Education Code, is |
|
amended by adding Section 21.4023 to read as follows: |
|
Sec. 21.4023. ADDITIONAL COMPENSATION FOR SUPPLEMENTAL |
|
INSTRUCTION. (a) A district shall provide additional compensation |
|
to a classroom teacher who voluntarily, but at the direction of the |
|
district, provides supplemental instruction to students before or |
|
after the regular school day. |
|
(b) The additional compensation required by this section |
|
must provide an hourly rate of compensation at least equal to the |
|
hourly rate received by the classroom teacher through the teacher's |
|
regular salary. |
|
(c) Any compensation provided under this section is not |
|
included in determining whether the district is paying the teacher |
|
the minimum monthly salary under Section 21.402. |
|
(d) A school district may use funds provided for an |
|
intensive program of instruction under Section 28.0213(c) to pay |
|
additional compensation required by this section. |
|
(e) Notwithstanding any other provision of law, a school |
|
district may not require a classroom teacher to provide |
|
supplemental instruction to a student before or after the regular |
|
school day. |
|
(f) For purposes of this section, "regular school day" means |
|
an eight-hour period each weekday. |
|
SECTION 2. This Act applies beginning with the 2007-2008 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
