A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the assignment of visiting judges. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 74.053(b), Government Code, is amended |
|
|
to read as follows: |
|
|
(b) If a party to a civil or criminal case files a timely |
|
|
objection to the assignment, the judge shall not hear the case. |
|
|
Except as provided by Subsection (d), each party to the case is only |
|
|
entitled to one objection under this section for that case. |
|
|
SECTION 2. The change in law made by this Act to Section |
|
|
74.053, Government Code, applies only to the right to object to the |
|
|
assignment of a judge assigned under Chapter 74, Government Code, |
|
|
on or after the effective date of this Act. An objection to the |
|
|
assignment of a judge assigned under Chapter 74, Government Code, |
|
|
before the effective date of this Act is governed by the law in |
|
|
effect on the date of the assignment, and that law is continued in |
|
|
effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
