A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the construction of road ways adjacent to schools. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 251.051, Transportation Code, is amended |
|
|
by adding 251.051(e) to read as follows: |
|
|
(e) the commissioners court shall not begin construction of |
|
|
a street or road in front of, or adjacent to, a public school, other |
|
|
than an institution of higher education, until the board of |
|
|
trustees of the school district provides consent to do so. |
|
|
SECTION 2. Section 311.001, Transportation Code, is amended |
|
|
by adding 311.001(c) to read as follows: |
|
|
(c) the municipality shall not begin construction of a |
|
|
street or road in front of, or adjacent to, a public school, other |
|
|
than an institution of higher education, until the board of |
|
|
trustees of the school district provides consent to do so. |
|
|
SECTION 3. Section 311.002, Transportation Code, is amended |
|
|
by adding 311.002(d) to read as follows: |
|
|
(d) the municipality shall not begin construction of a |
|
|
street or road in front of, or adjacent to, a public school, other |
|
|
than an institution of higher education, until the board of |
|
|
trustees of the school district provides consent to do so. |
|
|
SECTION 4. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
