A BILL TO BE ENTITLED
AN ACT
relating to notification by the Texas Commission on Environmental
Quality to certain elected officials of an application for a permit
to drill an injection well used for in situ uranium mining.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter E, Chapter 27, Water Code, is amended
by adding Section 27.074 to read as follows:
       Sec. 27.074.  NOTICE OF APPLICATION FOR IN SITU URANIUM
MINING. (a)  At the time an application for a permit authorizing in
situ uranium mining is submitted under this chapter, the applicant
shall mail notice of the application to the governing body of each
political subdivision that has jurisdiction over the location of
the proposed injection well.
       (b)  The notice must include information sufficient for the
members of the governing body to identify the location of the
activities proposed to be permitted.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
