A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the discharge of certain weapons in or on the beds or |
|
banks of navigable rivers or streams in certain counties; providing |
|
a criminal penalty. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. The heading to Chapter 284, Parks and Wildlife |
|
Code, is amended to read as follows: |
|
CHAPTER 284. DIMMIT, EDWARDS, FRIO, IRION, KENEDY, KIMBLE, |
|
LLANO, MASON, MAVERICK, REAL, UVALDE, AND ZAVALA COUNTIES |
|
SECTION 2. Section 284.001, Parks and Wildlife Code, is |
|
amended by amending Subsections (b) and (d) and adding Subsection |
|
(f) to read as follows: |
|
(b) This section applies only to a navigable river or stream |
|
located wholly or partly in Dimmit, Edwards, Frio, Irion, Kenedy, |
|
Kimble, Llano, Mason, Maverick, Real, Uvalde, or Zavala County. |
|
(d) This section does not apply to: |
|
(1) an individual acting in the scope of the |
|
individual's duties as a peace officer or department employee; [or] |
|
(2) the discharge of a shotgun loaded with ammunition |
|
that releases only shot when discharged; or |
|
(3) bow fishing in Dimmit, Uvalde, or Zavala County. |
|
(f) Notwithstanding Subsection (d)(2), in Dimmit, Uvalde, |
|
or Zavala County, a person may discharge a shotgun loaded with |
|
ammunition that releases only shot when discharged only if the |
|
person is hunting: |
|
(1) migratory birds, as defined by Section 34.021; or |
|
(2) game animals, as defined by Section 63.001, except |
|
mule deer, white-tailed deer, or antelope. |
|
SECTION 3. This Act takes effect September 1, 2007. |
