A BILL TO BE ENTITLED
AN ACT
relating to an optional checkoff fee on fishing licenses for the
benefit of the Texas Water Trust.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 46, Parks and Wildlife
Code, is amended by adding Section 46.0087 to read as follows:
       Sec. 46.0087.  OPTIONAL FEE FOR BENEFIT OF TEXAS WATER
TRUST.  (a)  Each person to whom a license or tag is to be issued
under this chapter may pay an optional fee for the benefit of the
Texas Water Trust created by Section 15.7031, Water Code, at the
time the person pays the fees required to be paid before the license
or tag is issued.
       (b)  The minimum amount that may be paid by a person as an
optional fee under this section is $5. A person may pay more than
the minimum amount.
       (c)  The commission's forms shall provide:
             (1)  spaces for a person to indicate the amount of the
optional fee the person desires to pay under this section, with
spaces for the amounts of $5, $10, or "other amount"; and
             (2)  a short explanation of the purpose of the optional
fee.
       (d)  The optional fee paid by a person under this section
shall be deposited in the general revenue fund to the credit of the
Texas Water Development Board.
       (e)  Notwithstanding any other provision of law, the fees
paid under this section may be used only for the purpose of
acquiring water rights from willing sellers to be held by the Texas
Water Trust. In the event of a conflict between this section and
any provision of an appropriations act, this section prevails.
       SECTION 2.  This Act takes effect September 1, 2007.
