A BILL TO BE ENTITLED
AN ACT
relating to a program to reduce mercury emissions from coal-fired
electric generating facilities.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter B, Chapter 382, Health and Safety
Code, is amended by adding Section 382.0206 to read as follows:
       Sec. 382.0206.  MERCURY EMISSIONS FROM COAL-FIRED ELECTRIC
GENERATING FACILITIES. (a)  The commission by rule shall establish
a program to reduce mercury emissions from coal-fired electric
generating facilities by requiring, in two stages, installation of
pollution control equipment or other measures to reduce mercury
emissions from those facilities to increase mercury capture rates
to:
             (1)  85 percent by December 31, 2009; and
             (2)  95 percent by December 31, 2013.
       (b)  The program developed under Subsection (a):
             (1)  must provide flexibility with respect to
implementation to reduce the economic cost of meeting the
requirements of the program; and
             (2)  may not allow a coal-fired electric generating
facility to purchase or trade any mercury emissions credits with a
facility in another state.
       SECTION 2.  The Texas Commission on Environmental Quality
shall adopt rules to implement Section 382.0206, Health and Safety
Code, as added by this Act, not later than December 31, 2007.
       SECTION 3.  This Act takes effect September 1, 2007.
