A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a program to reduce mercury emissions from coal-fired |
|
electric generating facilities. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 382, Health and Safety |
|
Code, is amended by adding Section 382.0206 to read as follows: |
|
Sec. 382.0206. MERCURY EMISSIONS FROM COAL-FIRED ELECTRIC |
|
GENERATING FACILITIES. (a) The commission by rule shall establish |
|
a program to reduce mercury emissions from coal-fired electric |
|
generating facilities by requiring, in two stages, installation of |
|
pollution control equipment or other measures to reduce mercury |
|
emissions from those facilities to increase mercury capture rates |
|
to: |
|
(1) 85 percent by December 31, 2009; and |
|
(2) 95 percent by December 31, 2013. |
|
(b) The program developed under Subsection (a): |
|
(1) must provide flexibility with respect to |
|
implementation to reduce the economic cost of meeting the |
|
requirements of the program; and |
|
(2) may not allow a coal-fired electric generating |
|
facility to purchase or trade any mercury emissions credits with a |
|
facility in another state. |
|
SECTION 2. The Texas Commission on Environmental Quality |
|
shall adopt rules to implement Section 382.0206, Health and Safety |
|
Code, as added by this Act, not later than December 31, 2007. |
|
SECTION 3. This Act takes effect September 1, 2007. |
