A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to contingent fees paid to influence the purchase of goods |
|
or services by a state agency; imposing a penalty. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 305.022, Government Code, is amended by |
|
amending Subsection (b) and adding Subsection (e) to read as |
|
follows: |
|
(b) A person may not accept any employment or render any |
|
service to influence legislation or administrative action for |
|
compensation contingent on: |
|
(1) the passage or defeat of any legislation; |
|
(2) [,] the governor's approval or veto of any |
|
legislation; [,] or |
|
(3) the outcome of any administrative action, |
|
including administrative action relating to the purchase of goods |
|
or services by a state agency or the selection of a provider of |
|
those goods or services. |
|
(e) This section does not prohibit the payment of a sales |
|
commission or similar compensation to an employee of a vendor of a |
|
product or a provider of a service if: |
|
(1) the purchase of the product or service is not |
|
subject to competitive bidding or competitive proposal |
|
requirements or the cost of the product or service otherwise does |
|
not exceed a maximum cost limit established by commission rule; or |
|
(2) the product or service is on a state catalog or |
|
similar listing of prequalified products or services for purchase |
|
by a state agency. |
|
SECTION 2. Section 305.022(c), Government Code, is |
|
repealed. |
|
SECTION 3. The change in law made by this Act applies only |
|
to an offense committed on or after September 1, 2007. An offense |
|
committed before September 1, 2007, is covered by the law in effect |
|
when the offense was committed, and the former law is continued in |
|
effect for that purpose. For purposes of this section, an offense |
|
was committed before September 1, 2007, if any element of the |
|
offense was committed before that date. |
|
SECTION 4. This Act takes effect September 1, 2007. |
