A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the regulation of certain business transactions. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. The legislature by law shall regulate the sale at |
|
wholesale or retail of goods produced or imported into this state, |
|
including promotional activities pre-dating the sale, to vendors |
|
who sell or otherwise dispense the goods to ultimate consumers |
|
under circumstances in which the legislature determines, or has |
|
determined, that the transactions need to be regulated to protect |
|
consumers of the goods and other important state interests. The |
|
state regulation may include provisions for the rental, sale, or |
|
other use of equipment to be used in delivering the goods to the |
|
ultimate consumers. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
