A BILL TO BE ENTITLED
AN ACT
relating to the regulation of certain business transactions.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  The legislature by law shall regulate the sale at
wholesale or retail of goods produced or imported into this state,
including promotional activities pre-dating the sale, to vendors
who sell or otherwise dispense the goods to ultimate consumers
under circumstances in which the legislature determines, or has
determined, that the transactions need to be regulated to protect
consumers of the goods and other important state interests.  The
state regulation may include provisions for the rental, sale, or
other use of equipment to be used in delivering the goods to the
ultimate consumers.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
