A BILL TO BE ENTITLED
AN ACT
relating to the enforcement and regulation of laws by state
agencies.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subtitle C, Title 10, Government Code, is
amended by adding Chapter 2115 to read as follows:
CHAPTER 2115.  ENFORCEMENT OF LAWS BY STATE AGENCIES.
       Sec. 2115.001.  DEFINITION.  In this chapter, "state agency" 
means an agency, department, institution, commission, or other
entity in the executive branch of state government.
       Sec. 2115.002.  REQUIREMENT.  A state agency shall enforce
the laws enacted by the legislature, eliminating any identifiable
agency inefficiencies, for the regulation of business transactions
by persons under the jurisdiction of the agency regarding the sale
at wholesale or retail of goods produced or imported into this
state, including promotional activities pre-dating the sale, to
vendors who sell or otherwise dispense the goods to ultimate
consumer.  The enforcement shall include any regulation by law of
the sale, rental, or other use of equipment to be used in delivering
the good to ultimate consumer.  This chapter may be limited to
business transactions for which the legislature determines, or has
determined, that the state has an abiding public interest.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
