A BILL TO BE ENTITLED
AN ACT
relating to funding of the Alternative Fuels Research and Education
Division of the Railroad Commission of Texas
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  113.246 (b), Natural Resources Code, is amended
to read as follows:
       (b)  The rebate program provided in Section 113.2435 shall be
funded by 50 percent of the total delivery fees collected under
Section 113.244. Administrative costs for the Alternative Fuels
Research and Education Division may not exceed 25 percent of the
total delivery fees collected. The remainder of the total delivery
fees collected may be expended at the discretion of the commission.
       (1)  Any and all unexpended balances carried forward from the
previous fiscal year as of August 31, 2008 from appropriations made
from the Alternative Fuels Research and Education account and
collected pursuant to Natural Resources Code, Section 113.243 shall
be dedicated to and used exclusively for the purpose of consumer
rebates and shall be carried forward into the following fiscal year
and remain differentiated as consumer rebate funds in the
Alternative Fuels Research and Education Account 101 pursuant to
Natural Resources Code, Section 113.2435.
       (2)  These carry over funds shall not be considered in
determining the amount of Available Funds for the current fiscal
year as cited in Section 113.2435(c)(5) of the Texas Natural
Resources Code which establishes the requirement of using not more
than 50% of funds available for the consumer rebate program in the
Account 101 fund in any fiscal year.
       (3)  Carry over funds are not to impede with the statutory
maximum parentage requirement language concerning not more then 50%
of funds available to be used in any category.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
