A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the funding of the Alternative Fuels Research and |
|
Education Division of the Railroad Commission of Texas. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 113.246(b), Natural Resources Code, is |
|
amended to read as follows: |
|
(b) The rebate program provided in Section 113.2435 shall be |
|
funded by 50 percent of the total delivery fees collected under |
|
Section 113.244. Administrative costs for the Alternative Fuels |
|
Research and Education Division program may not exceed 25 percent |
|
of the total delivery fees collected. The remainder of the total |
|
delivery fees collected may be expended at the discretion of the |
|
commission. Notwithstanding the limitation on consumer rebate |
|
program spending imposed by Section 113.2435(c)(5), on August 31, |
|
2008, the commission shall carry forward unexpended amounts that |
|
were budgeted for consumer rebate programs during the state fiscal |
|
year ending on that date and shall include those amounts in the |
|
commission's operating budget for consumer rebate programs for the |
|
state fiscal year beginning September 1, 2008, conditioned on the |
|
commission reserving no more than 50 percent of those amounts, to |
|
the degree necessary for operational cash flow. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
