A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the powers, duties, and composition of the governing |
|
board of the Texas Youth Commission. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. REPEALER. Subsection (a), Section 61.012, Human |
|
Resources Code, is repealed. |
|
SECTION 2. AMENDMENT. Section 61.012, Human Resources |
|
Code, is amended by adding Subsection (e) to read as follows: |
|
(e) The governing board of the Texas Youth Commission |
|
consists of seven members appointed by the governor with the |
|
consent of the senate. Appointments to the board shall be made |
|
without regard to the race, color, disability, sex, religion, age, |
|
or national origin of the appointees. |
|
SECTION 3. TRANSITION; TERMINATION OF PREVIOUSLY APPOINTED |
|
BOARD. The terms of all members of the governing board of the Texas |
|
Youth Commission who were appointed under Subsection (a), Section |
|
61.012, Human Resources Code, as repealed by this Act, expire on the |
|
effective date of this Act. The position to which the members were |
|
appointed to is abolished and there is no position for the member to |
|
hold over to. |

SECTION 4. TRANSITION; RESTRICTIONS ON APPOINTMENT ON NEW |
|
BOARD. In making appointments to the governing board of the Texas |
|
Youth Commission under Subsection (e), Section 61.012, Human |
|
Resources Code, as added by this Act, the governor may not appoint |
|
any person who was appointed as a member of the governing board of |
|
the Texas Youth Commission under Subsection (a), Section 61.012, |
|
Human Resources Code, as repealed by this Act. |
|
SECTION 5. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
