A BILL TO BE ENTITLED
 
AN ACT
  relating to the name, directors, and elections of the Emerald
  Underground Water Conservation District.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 712, Acts of the 71st Legislature,
  Regular Session, 1989, is amended by adding Section 1A to read as
  follows:
         Sec. 1A.  NAME OF DISTRICT.  The name of the Emerald
  Underground Water Conservation District is changed to the Crockett
  County Groundwater Conservation District.
         SECTION 2.  Section 2, Chapter 712, Acts of the 71st
  Legislature, Regular Session, 1989, is amended to read as follows:
         Sec. 2.  DEFINITION. In this Act, "district" means the
  Crockett County Groundwater [Emerald Underground Water]
  Conservation District.
         SECTION 3.  Section 7, Chapter 712, Acts of the 71st
  Legislature, Regular Session, 1989, is amended by adding Subsection
  (a-1) and amending Subsections (d) and (e) to read as follows:
         (a-1)  Notwithstanding Sections 49.001 and 49.002(b), Water
  Code, Section 49.052, Water Code, applies to a director of the
  district.
         (d)  Directors [Permanent directors other than initial
  permanent directors] serve staggered four-year terms, with the
  terms of two or three directors expiring December 1 of each
  even-numbered year.
         (e)  Each director must qualify to serve as director in the
  manner provided by Section 36.055 [Sections 51.078 and 51.079],
  Water Code.
         SECTION 4.  Chapter 712, Acts of the 71st Legislature,
  Regular Session, 1989, is amended by adding Sections 10A and 10B to
  read as follows:
         Sec. 10A.  DIRECTOR ELECTIONS. On the uniform election date
  in November of each even-numbered year, the appropriate number of
  directors shall be elected.
         Sec. 10B.  LOCATION OF DISTRICT ELECTIONS.  A district
  election may be held at any location in Crockett County.
         SECTION 5.  Sections 7(b) and (c) and 10, Chapter 712, Acts
  of the 71st Legislature, Regular Session, 1989, are repealed.
         SECTION 6.  Notwithstanding Section 7(d), Chapter 712, Acts
  of the 71st Legislature, Regular Session, 1989, as amended by this
  Act:
               (1)  the terms of the directors of the Emerald
  Underground Water Conservation District who were elected in May
  2005 expire December 1, 2008; and
               (2)  the terms of the directors of the Emerald
  Underground Water Conservation District who are elected in May 2007
  expire December 1, 2010.
         SECTION 7.  (a)  The legal notice of the intention to
  introduce this Act, setting forth the general substance of this
  Act, has been published as provided by law, and the notice and a
  copy of this Act have been furnished to all persons, agencies,
  officials, or entities to which they are required to be furnished
  under Section 59, Article XVI, Texas Constitution, and Chapter 313,
  Government Code.
         (b)  The governor has submitted the notice and Act to the
  Texas Commission on Environmental Quality.
         (c)  The Texas Commission on Environmental Quality has filed
  its recommendations relating to this Act with the governor,
  lieutenant governor, and speaker of the house of representatives
  within the required time.
         (d)  All requirements of the constitution and laws of this
  state and the rules and procedures of the legislature with respect
  to the notice, introduction, and passage of this Act are fulfilled
  and accomplished.
         SECTION 8.  This Act takes effect September 1, 2007.
