A JOINT RESOLUTION
proposing a constitutional amendment authorizing the legislature
to exempt poultry facilities from ad valorem taxation.
       BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Article VIII, Texas Constitution, is amended by
adding Section 19b to read as follows:
       Sec. 19b.  (a)  The legislature by general law may exempt
from ad valorem taxation a facility, including a building,
structure, or fixture, that:
             (1)  is used to raise, grow, feed, or otherwise produce
poultry for commercial purposes; or
             (2)  is a commercial poultry hatchery that is used to
produce chicks, ducklings, goslings, or poults.
       (b)  A general law enacted under this section may not exempt
from ad valorem taxation the land on which an exempt facility is
located.
       SECTION 2.  This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 6, 2007.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment authorizing the
legislature to exempt poultry facilities from ad valorem taxation."
