A JOINT RESOLUTION
|
|
|
proposing a constitutional amendment authorizing the legislature |
|
|
to exempt poultry facilities from ad valorem taxation. |
|
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article VIII, Texas Constitution, is amended by |
|
|
adding Section 19b to read as follows: |
|
|
Sec. 19b. (a) The legislature by general law may exempt |
|
|
from ad valorem taxation a facility, including a building, |
|
|
structure, or fixture, that: |
|
|
(1) is used to raise, grow, feed, or otherwise produce |
|
|
poultry for commercial purposes; or |
|
|
(2) is a commercial poultry hatchery that is used to |
|
|
produce chicks, ducklings, goslings, or poults. |
|
|
(b) A general law enacted under this section may not exempt |
|
|
from ad valorem taxation the land on which an exempt facility is |
|
|
located. |
|
|
SECTION 2. This proposed constitutional amendment shall be |
|
|
submitted to the voters at an election to be held November 6, 2007. |
|
|
The ballot shall be printed to permit voting for or against the |
|
|
proposition: "The constitutional amendment authorizing the |
|
|
legislature to exempt poultry facilities from ad valorem taxation." |
