A JOINT RESOLUTION
proposing a constitutional amendment authorizing garnishment of
wages for court-ordered restitution in a criminal judgment.
       BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 28, Article XVI, Texas Constitution, is
amended to read as follows:
        Sec. 28.  No current wages for personal service shall ever
be subject to garnishment, except for the enforcement of
court-ordered:
             (1)  child support payments; [or]
             (2)  spousal maintenance; or
             (3)  restitution in a criminal judgment.
       SECTION 2.  This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 6, 2007.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment authorizing
garnishment of wages for court-ordered restitution in a criminal
judgment."
