A JOINT RESOLUTION
proposing a constitutional amendment establishing the right to
hunt, fish, and otherwise enjoy reasonable access to certain
natural resources and the right to enjoy clean air and water.
       BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Article I, Texas Constitution, is amended by
adding Section 33 to read as follows:
       Sec. 33.  Each person has the right to hunt and fish on
public or private lands and public or private waters, the right to
enjoy reasonable access to public lands and public waters for
hunting, fishing, and other purposes, and the right to enjoy clean
air and water. The state holds wildlife, wild fish, public lands,
public waters, and air in trust for the use and benefit of the
public. The Legislature shall enact any laws that may be necessary
to protect those rights and to secure those resources for future
generations. This section does not allow a person access to private
land or private water to hunt or fish without permission from the
owner of the private land or private water.
       SECTION 2.  This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 6, 2007.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment establishing the right
to hunt, fish, and otherwise enjoy reasonable access to wildlife,
fish, and public lands and public waters, and the right to enjoy
clean air and water."
