A JOINT RESOLUTION
proposing a constitutional amendment requiring a contract with an
entity to operate the state lottery to be approved by a majority of
the members of each house of the legislature.
       BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 47(e), Article III, Texas Constitution,
is amended to read as follows:
       (e)  The Legislature by general law may authorize the State
to operate lotteries and may authorize the State to enter into a
contract with one or more legal entities that will operate
lotteries on behalf of the State. A contract authorizing an entity
to operate lotteries on behalf of the State, including the renewal
of an existing contract, must be approved by a resolution approved
by a majority of the members of each house of the Legislature before
the contract can take effect and be enforceable.
       SECTION 2.  This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 6, 2007.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment requiring a contract to
authorize an entity to operate the state lottery on behalf of the
state to be approved by a majority of the members of each house of
the legislature."
