A JOINT RESOLUTION
proposing a constitutional amendment providing for use of a portion
of the money in the Texas Mobility Fund for mass transit projects.
       BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 49-k(a), Article III, Texas
Constitution, is amended by adding Subdivision (4-a) to read as
follows:
             (4-a)  "Mass transit" means the transportation of
passengers and hand-carried packages or baggage of a passenger by
bus, light rail, or commuter rail.
       SECTION 2.  Section 49-k, Article III, Texas Constitution,
is amended by adding Subsection (c-1) to read as follows:
       (c-1)  Notwithstanding Subsections (b) and (c) of this
section, at least 20 percent of the money dedicated to the fund
under Subsection (e) of this section must be used to make grants to
municipalities to finance mass transit projects. To be eligible to
receive a grant under this subsection, a municipality must dedicate
to those projects an amount of its own money equal to the amount of
the grant. Money from the grant and matching money provided by the
municipality may be used to finance mass transit projects of the
municipality or of other governmental entities providing mass
transit services within the boundaries of the municipality,
regardless of whether the projects of the other governmental entity
are within those boundaries. The legislature shall establish the
procedures and may establish additional eligibility requirements
for grants under this subsection.
       SECTION 3.  This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 6, 2007.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment providing for use of a
portion of the money in the Texas Mobility Fund for mass transit
projects."
