A JOINT RESOLUTION
proposing a constitutional amendment relating to the manner in
which the lieutenant governor's compensation and reimbursement for
expenses are determined.
       BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 17(b), Article IV, Texas Constitution,
is amended to read as follows:
       (b)(1)  The Lieutenant Governor shall, while acting as
President of the Senate, receive for his or her services an annual
salary in an amount equal to the average of the annual salaries of
the Comptroller of Public Accounts, the Commissioner of the General
Land Office, and the Attorney General, and be entitled to the same
reimbursement for expenses as those officers.
             (2)  During [the same compensation and mileage which
shall be allowed to the members of the Senate, and no more unless
the Texas Ethics Commission recommends and the voters approve a
higher salary, in which case the salary is that amount; and during]
the time the Lieutenant Governor exercises the powers and authority
appertaining to the office of Governor, the Lieutenant Governor
shall receive in like manner the same compensation which the
Governor would have received had the Governor been employed in the
duties of that office, and no more.
             (3)  An increase in the emoluments of the office of
Lieutenant Governor does not make a member of the Legislature
ineligible to serve in the office of Lieutenant Governor.
       SECTION 2.  The following temporary provision is added to
the Texas Constitution:
       TEMPORARY PROVISION. (a) This temporary provision applies to
the constitutional amendment proposed by the 80th Legislature,
Regular Session, 2007, relating to the manner in which the
lieutenant governor's compensation and reimbursement for expenses
are determined.
       (b)  The amendment takes effect January 1, 2011.
       (c)  This temporary provision expires January 2, 2011.
       SECTION 3.  This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 6, 2007.
The ballots shall be printed to permit voting for or against the
proposition: "The constitutional amendment setting the
compensation of the lieutenant governor at an amount equal to the
average annual salary of the comptroller, the commissioner of the
general land office, and the attorney general, and providing that
the lieutenant governor is entitled to the same reimbursement for
expenses as those officers."
