R E S O L U T I O N
 
         BE IT RESOLVED by the House of Representatives of the State of
  Texas, 80th Legislature, Regular Session, 2007, That House Rule 13,
  Section 9(a), be suspended in part as provided by House Rule 13,
  Section 9(f), to enable the conference committee appointed to
  resolve the differences on Senate Bill No. 218 (licensing and
  inspection requirements of the Department of Family and Protective
  Services for certain facilities) to consider and take action on the
  following matter:
         House Rule 13, Section 9(a)(4), is suspended to permit the
  committee to add a new SECTION 5 to the bill to read as follows:
         SECTION 5.  (a) Notwithstanding Section 42.041(a), Human
  Resources Code, an after-school program operated directly by an
  educational facility accredited by the Texas Education Agency, the
  Texas Private School Accreditation Commission, or the Southern
  Association of Colleges and Schools, or an after-school program
  operated by another facility under contract with the educational
  facility, the curriculum content of which has been approved by one
  of those accrediting organizations, shall comply with any cited
  noncompliance with that section not later than September 1, 2009.
         (b)  Notwithstanding Subsection (a) of this section, the
  Department of Family and Protective Services may waive any
  requirement for obtaining a license under Chapter 42, Human
  Resources Code, applicable to an after-school program described by
  Subsection (a) of this section or the date by which the program must
  obtain a license as prescribed by that subsection.
         Explanation:  The addition of the SECTION to the bill is
  necessary to give certain after-school programs that, under the
  provisions of S.B. No. 218, become subject to the licensing
  requirements of Chapter 42, Human Resources Code, time to comply
  with those requirements and to clarify that the Department of
  Family and Protective Services may waive a requirement for
  obtaining the license on the date by which the license must be
  obtained.
