A BILL TO BE ENTITLED
AN ACT
relating to the definition of serious bodily injury for the
purposes of criminal prosecutions.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 1.07(a)(46), Penal Code, is amended to
read as follows:
             (46)  "Seri
ous bodily injury" means:
                   (A) bodily injury that creates a substantial risk
of death or that causes death, serious permanent disfigurement, or
protracted loss or impairment of the function of any bodily member
or organ; or
                   (B)  strangulation by impeding normal breathing
or circulation of the blood of another person by applying pressure
on the person's throat or neck or blocking the person's nose or
mouth.
       SECTION 2.  The change in law made by this Act applies only
to an offense committed on or after September 1, 2007. An offense
committed before September 1, 2007, is governed by the law in effect
when the offense was committed, and the former law is continued in
effect for that purpose. For purposes of this section, an offense
was committed before September 1, 2007, if any element of the
offense was committed before that date.
       SECTION 3.  This Act takes effect September 1, 2007.
