A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to excepting from required disclosure under the public |
|
information law certain personal information maintained by a |
|
municipality that pertains to a minor. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 552, Government Code, is |
|
amended by adding Section 552.148 to read as follows: |
|
Sec. 552.148. EXCEPTION: CERTAIN PERSONAL INFORMATION |
|
MAINTAINED BY MUNICIPALITY PERTAINING TO A MINOR. (a) In this |
|
section, "minor" means a person younger than 18 years of age. |
|
(b) The following information maintained by a municipality |
|
for purposes related to the participation by a minor in a |
|
recreational program or activity is excepted from the requirements |
|
of Section 552.021: |
|
(1) the name, age, home address, home telephone |
|
number, or social security number of the minor; |
|
(2) a photograph of the minor; and |
|
(3) the name of the minor's parent or legal guardian. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
