A BILL TO BE ENTITLED
AN ACT
relating to training requirements for certain youth programs.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 141.0021, Health and Safety Code, is
amended to read as follows:
       Sec. 141.0021.  EXEMPTION. Except as provided by Section
141.0097, this [This] chapter does not apply to a facility or
program operated by or on the campus of an institution of higher
education or a private or independent institution of higher
education as those terms are defined by Section 61.003, Education
Code, that is regularly inspected by one or more local governmental
entities for compliance with health and safety standards.
       SECTION 2.  Chapter 141, Health and Safety Code, is amended
by adding Section 141.0097 to read as follows:
       Sec. 141.0097.  TRAINING PROVIDED BY INSTITUTION OF HIGHER
EDUCATION.  An institution of higher education or a private or
independent institution of higher education as those terms are
defined by Section 61.003, Education Code, shall provide the
training required by Section 141.0095 to its employees and
volunteers who will be in contact with minor participants of a youth
camp operated by the institution of higher education and shall
otherwise comply with Section 141.0095 in the same manner as a
person holding a license under this chapter.
       SECTION 3.  This Act takes effect September 1, 2007.
