A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of a collection improvement program to |
|
|
collect court costs, fees, and fines imposed as a condition of |
|
|
community supervision. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article 103.0033, Code of Criminal Procedure, is |
|
|
amended by adding Subsection (k) to read as follows: |
|
|
(k) A court cost, fee, or fine imposed as a condition of |
|
|
community supervision may be collected through a program only if |
|
|
the court that orders the community supervision authorizes the |
|
|
collection through the program. |
|
|
SECTION 2. The change in law made by this Act applies to a |
|
|
court cost, fee, or fine imposed as a condition of community |
|
|
supervision that is authorized by the imposing court to be |
|
|
collected by a collection improvement program under Article |
|
|
103.0033, Code of Criminal Procedure, regardless of whether the |
|
|
court cost, fee, or fine was imposed before, on, or after the |
|
|
effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
