A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the validation of governmental acts and proceedings of |
|
|
the Texas Water Development Board pertaining to a regional water |
|
|
plan submitted after the applicable deadline. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. (a) All governmental acts and proceedings of the |
|
|
Texas Water Development Board related to the approval and inclusion |
|
|
in the state water plan for the five-year period beginning January |
|
|
5, 2007, of a regional water plan that was submitted to the board |
|
|
after the deadline prescribed by Section 16.053(i), Water Code, are |
|
|
validated as of the date they occurred if the regional water plan: |
|
|
(1) was adopted by the applicable regional water |
|
|
planning group not later than January 19, 2006; and |
|
|
(2) meets the other requirements of Section 16.053, |
|
|
Water Code. |
|
|
(b) This section does not apply to any matter that on the |
|
|
effective date of this Act: |
|
|
(1) is involved in litigation if the litigation |
|
|
ultimately results in the matter being held invalid by a final court |
|
|
judgment; or |
|
|
(2) has been held invalid by a final court judgment. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
