A BILL TO BE ENTITLED
AN ACT
relating to authorizing the Texas Board of Criminal Justice to
contract with a private vendor for certain correctional facilities.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 495, Government Code, is
amended by adding Section 495.009 to read as follows:
       Sec. 495.009.  CONTRACT FOR FACILITY IN UNITED MEXICAN
STATES. (a) The board may contract with a private vendor under
this subchapter for the operation, maintenance, and management of a
secure correctional facility in the United Mexican States. A
facility operated, maintained, and managed under this section must
be used exclusively to house inmates who are foreign nationals from
the United Mexican States.
       (b)  The requirements imposed on a contract entered into
under this subchapter apply to a contract under this section,
except that the board may waive any requirement that is
inapplicable by virtue of the fact that the facility is located
outside of the United States.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
