A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to authorizing the Texas Board of Criminal Justice to |
|
|
contract with a private vendor for certain correctional facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 495, Government Code, is |
|
|
amended by adding Section 495.009 to read as follows: |
|
|
Sec. 495.009. CONTRACT FOR FACILITY IN UNITED MEXICAN |
|
|
STATES. (a) The board may contract with a private vendor under |
|
|
this subchapter for the operation, maintenance, and management of a |
|
|
secure correctional facility in the United Mexican States. A |
|
|
facility operated, maintained, and managed under this section must |
|
|
be used exclusively to house inmates who are foreign nationals from |
|
|
the United Mexican States. |
|
|
(b) The requirements imposed on a contract entered into |
|
|
under this subchapter apply to a contract under this section, |
|
|
except that the board may waive any requirement that is |
|
|
inapplicable by virtue of the fact that the facility is located |
|
|
outside of the United States. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
