A BILL TO BE ENTITLED
|

AN ACT
|
|
relating to dismissal of the charge in certain motor vehicle |
|
equipment offenses. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 547.004, Transportation Code, is amended |
|
by adding Subsection (c) to read as follows: |
|
(c) The court may dismiss a charge of an offense under this |
|
section involving a vehicle other than a commercial vehicle, as |
|
defined by Section 548.001, if the defendant presents proof |
|
satisfactory to the court that the defendant remedied the defect |
|
within 20 working days after the date of the offense or before the |
|
defendant's first court appearance date, whichever is later. The |
|
court may assess an administrative fee not to exceed $20 when the |
|
charge is dismissed, or may waive the fee if the waiver is in the |
|
interest of justice. |
|
SECTION 2. This Act takes effect September 1, 2007. |
