A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the powers of certain cooperative associations to |
|
|
provide central heating and cooling services. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 301.038, Health and Safety Code, is |
|
|
amended to read as follows: |
|
|
Sec. 301.038. PROVISION [COST] OF SERVICES; COSTS. (a) A |
|
|
cooperative association may provide services from a system to |
|
|
eligible institutions and may determine the amount to be charged |
|
|
for providing the services. |
|
|
(b) Notwithstanding Sections 301.032 and 301.037, a |
|
|
cooperative association may provide from a system central heating |
|
|
and cooling services, including steam and heated and chilled water |
|
|
supply, to persons other than eligible institutions and may |
|
|
determine the amount to be charged for providing the services. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
