A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the powers of certain cooperative associations to
  provide central heating and cooling services.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 301.038, Health and Safety Code, is
  amended to read as follows:
         Sec. 301.038.  PROVISION [COST] OF SERVICES; COSTS.
  (a)  A cooperative association may provide services from a system
  to eligible institutions and may determine the amount to be charged
  for providing the services.
         (b)  Notwithstanding Sections 301.032 and 301.037, a
  cooperative association may provide from a system central heating
  and cooling services, including steam and heated and chilled water
  supply, to persons other than eligible institutions and may
  determine the amount to be charged for providing the services.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2007.
