A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the design and construction of a cenotaph in the State
  Cemetery to honor 19th-century African American members of the
  Texas Legislature.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 2165.256, Government Code, is amended by
  adding Subsection (t) to read as follows:
         (t)  The committee shall provide for the design and
  construction of a cenotaph in the State Cemetery in honor of
  19th-century African American members of the Texas Legislature.  At
  the committee's request, the commission shall provide financial,
  technical, or other assistance to the committee in relation to:
               (1)  the design or construction of the cenotaph; or
               (2)  entering into a contract with another entity for
  the design, construction, or both the design and construction of
  the cenotaph.
         SECTION 2.  If the State Cemetery Committee does not receive
  an appropriation under Subsection (k), Section 2165.2561,
  Government Code, for the state fiscal biennium that begins
  September 1, 2007, in an amount sufficient to enable the committee
  to perform its duties under Subsection (t), Section 2165.256,
  Government Code, as added by this Act, in addition to the amounts
  necessary to enable the committee to perform its other duties, the
  Texas Building and Procurement Commission shall transfer to the
  committee during the biennium under an interagency contract an
  amount, not to exceed $20,000, sufficient to enable the committee
  with the assistance of the commission to perform the committee's
  duties under Subsection (t), Section 2165.256.
         SECTION 3.  This Act takes effect September 1, 2007.
