A BILL TO BE ENTITLED
AN ACT
relating to the authority of a visiting judge for a district court
to conduct proceedings at the county seat of a county other than the
county in which a case is pending.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 24, Government Code, is
amended by adding Section 24.023 to read as follows:
       Sec. 24.023.  LOCATION OF PROCEEDINGS CONDUCTED BY VISITING
JUDGE. A visiting judge for a district court may conduct
proceedings at the county seat of a county other than the county in
which a case is pending if authorized by Section 7, Article V, Texas
Constitution.
       SECTION 2.  This Act takes effect January 1, 2009, but only
if the constitutional amendment proposed by the 80th Legislature,
Regular Session, 2007, allowing a visiting judge of a district
court to hold proceedings at the county seat of a county other than
the county in which a case is pending on the written agreement of
all parties to the case and approval by the judge, is approved by
the voters. If that amendment is not approved by the voters, this
Act has no effect.
