A BILL TO BE ENTITLED
AN ACT
relating to the penalty for driving a motor vehicle on a highway
without a valid driver's license.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subsections (e) and (f), Section 521.457,
Transportation Code, are amended to read as follows:
       (e)  Except as provided by Subsection (f), an offense under
this section is a Class C misdemeanor [punishable by:
             [(1)  a fine of not less than $100 or more than $500;
and
             [(2)  confinement in county jail for a term of not less
than 72 hours or more than six months].
       (f)  If it is shown on the trial of an offense under this
section that the person has previously been convicted of an offense
under this section or an offense under Section 601.371(a), as that
law existed before September 1, 2003, the offense is a Class B [A]
misdemeanor.
       SECTION 2.  (a)  The change in law made by this Act applies
only to an offense committed on or after the effective date of this
Act. For purposes of this section, an offense is committed before
the effective date of this Act if any element of the offense occurs
before that date.
       (b)  An offense committed before the effective date of this
Act is covered by the law in effect when the offense was committed,
and the former law is continued in effect for that purpose.
       SECTION 3.  This Act takes effect September 1, 2007.
